It is necessary to submit a signed Waiver, Release, and Consent to participate. An original document will be available before the trip for you to review and sign.
I hereby agree to release, hold harmless and discharge Cycle America, Cycle America LLC, and its officers, members, representatives, agents, employees, event leaders, and assigns (hereinafter collectively referred to as “Cycle America”), and any associated organization (including, but not limited to, federal and state agencies, school districts, municipalities, churches, clubs, campgrounds, sponsors, volunteers), and any employee or agent thereof (hereinafter collectively referred to as “its Associates”) from any liability, causes of action, suits, debts, contracts, agreements, claims or demands arising out of my participation in a Cycle America event or activity (hereinafter collectively referred to as "the Events"), including liability or claims based on the negligence or fault of Cycle America or its Associates.
I acknowledge that accidents, fatalities, serious bodily injuries, illness, and/or property damage can occur while participating in the Events, while riding a bicycle on public and/or private roads or while otherwise traveling to and from the Events. I acknowledge that Cycle America and its Associates have made no representations or guaranties as to the safety of the Events to me, and that I knowingly and freely assume all such risks, whether known or unknown. I further agree to release Cycle America and its Associates from liability for any injury, death, illness or property damage occurring while participating in the Events or in the travel to and from the Events, even if caused by a negligent act or omission by Cycle America or its Associates.
I attest that I am physically fit and capable of participating in the Events and I will sufficiently prepare in order to complete the Events entered. I agree to ride in a safe manner and I will use good judgment and be self-reliant and I may request assistance from Cycle America especially if I am unsure of my ability to complete any segment of the Events safely. In the event of any injury or accident I agree to notify the event leader and consent to and permit emergency medical treatment.
I agree to wear a CPSC, ASTM, ANSI or SNELL approved bicycle helmet at all times when riding a bicycle during the Events. I further agree to have adequate medical insurance coverage for the duration of the Events. I understand that if I leave before or after the daily support times or travel a course different from the official route, I will not receive the services as published or advertised.
Firearms or other dangerous weapons are strictly prohibited throughout the Events and I attest that I will abide by the rules and regulations of the Events and all applicable federal, state, local, and municipal laws and regulations, including vehicle laws. I understand Cycle America reserves the right to suspend, without compensation, participants unwilling to abide by the rules and regulations of the Events including riding a bicycle in an unsafe manner or displaying unacceptable behavior. I also understand that Cycle America reserves the right to change or cancel the Events due to, but not limited to, health and safety concerns and will issue a credit equal to the total tour deposit(s). I further understand that I will not be reimbursed for airline fees and any travel expenses due to canceled or changed itineraries or compensated for the theft of any personal gear, including bicycles.
I give permission to Cycle America to use my name, photographs, motion pictures, recordings, evaluations or any other record of my participation in the Events for any promotional purposes, without obligation or liability to me. I also agree not to distribute, share, recreate, reproduce or publish, in any manner or medium, any Cycle America materials, including but not limited to maps, route directions, trip descriptions, and pre tour materials.
I agree that if any portion of this agreement is determined to be unenforceable by a court of law, all other parts shall remain in full force and effect and that the above provisions shall be binding upon my heirs and assigns. I understand and agree that this document may be used as evidence by Cycle America to defend any claims made as a result of my participation in the Events.
I have read and understand the above information, all Cycle America policies, including cancellations and refunds, and I agree to pay all fees associated with my registration and/or my participation in the Events, and I certify my compliance by checking the [ I AGREE ] Button above. It is agreed that this complete Waiver, Release and Consent is binding on my heirs and assigns.
If younger than 18 years old, a parent or guardian must agree to the following:
I, being the parent or legal guardian of the above entrant, who is less than eighteen (18) years of age, having read and understood this Waiver, Release and Consent in its entirety, do hereby consent that the above-mentioned entrant may participate in a Cycle America event or activity. I do hereby adopt entirely the above-recited "Waiver, Release and Consent" and I represent that I am authorized to accept this agreement for the minor child by checking the [ I AGREE ] Button above.
